Time to claim inheritance tax paid in Spain

Due to a change in Spanish regulation earlier this year, benefactors who paid inheritance tax (IHT) may be able to make a claim.

The EU Court of Justice ruled a decision, which considered that Spanish inheritance tax for non-residents, was discriminatory, due to the non-residents position being weaker. The reason being, as a non-resident, the benefactor could not benefit from the inheritance tax deductions available for tax residents in each of the Spanish regions.

This ruling means that those non-residents who paid IHT in the past recent years based on the former system could now claim the reimbursement of the amounts they paid, provided the case meets certain requirements.
