Community of Owners
We act for communities in recovering community fees and provide general advice in respect of community matters.
When you buy a property in Spain with common areas, you become a member of a Community of Owners, which is ruled by the Community’s by-laws and by the Spanish Law of Horizontal Division (Ley de Propiedad Horizontal).
We have lawyers who are experienced in Community matters and can provide you the following legal assistance:
- Attending the Annual/Extraordinary General Meeting and voting according to your wishes.
- Contesting the decisions taken at the General Meetings
- Review the community of owner’s bylaws and internal rules and provide you with general advice on this.
- Apply for authorisation to perform repairs and improvements to your property.
If you are an owner or tenant of a Spanish property we can assist you in drafting your tenancy agreement. If a dispute arises we can assist in resolving this and can take action on your behalf to claim any rental arrears or protect your rights as a tenant or owner.
Enforcing Foreign Court Orders in Spain
In the European Union there are specific regulations in order to make it easier to enforce a judgement issued in one Member state in another. Outside of the European Union there are International Regulations for enforcing orders in different countries where the court order has been issued.
We work with clients and foreign lawyers in enforcing orders in Spain and are familiar with the legal process to freeze Spanish Properties or bank accounts.
