Estates
Have you been appointed to handle Spanish assets under a Lasting Power of Attorney? Have you been appointed as an executor or trustee to an estate that includes Spanish assets?
Our team of specialist English speaking Spanish abogados, English, Scottish & Irish Solicitors have experience in advising heirs, executors and trustees when dealing with Spanish estates.
Estate Planning
If you have Spanish assets then upon death and depending on how you own the assets, Spanish inheritance tax is payable. We can assist in mitigating your Spanish inheritance tax liability and preparing your Spanish estate so that when the time comes, it will be easier for your loved ones to deal with the Spanish estate.
When there are estates with assets located in various countries it is important to work with lawyers in those countries and we are used to dealing with lawyers from around the world to administer Spanish estates.
If you are considering buying a property, part of the estate planning process starts once you have taken the decision to buy Spanish property. Download our leaflet on Spanish Property Ownership Options.
Advice to Executors & Trustees
We have experience in acting for executors and trustees in dealing with Spanish Estates and can assist in valuing and disposing of Spanish assets.
Dealing with Incapacity
Unfortunately if someone cannot manage their own affairs then an Administrator in Spain needs to be appointed and we can assist with this process. Or if an individual has been appointed with a Lasting Power of Attorney, action can be taken in Spain using this once it has been legalised and translated.
The incapacitated person´s assets should be protected by obtaining a court order that can be registered at the Land Registry. Even if the incapacitated person is not in Spain, but has Spanish assets or interests, a foreign order can be enforced at the Spanish Courts. If you have been appointed as a deputy of a incapacitated person and you wish to sell a property in Spain, we can assist you with all the aspects of the legal process.
