Lasting Powers of Attorney for the UK

  1. There are 2 types of Lasting Powers of Attorney – one for Health and Welfare and one for Property and Finance. The LPA for Health and Welfare would give the donor’s attorney(s) authority to make decisions on life sustaining treatment in case the donor has lost mental capacity. The attorneys would also be able to decide which medication the donor would take (in conjunction with any guidance from doctors), day-to-day care, diet etc. The LPA for Property and Finance is very important to have. It would give the donor’s attorney authority to buy and sell property on their behalf, manage their accounts, pay invoices, liaise with tax authorities etc.
  2. LPAs may be used during the lifetime of the donor. The donor would be able to appoint up to 4 attorneys and up to 4 replacement attorneys to act jointly or jointly and severally. The donor should appoint someone they trust to handle their affairs on their behalf in case they are mentally or physically incapable of doing so on their own. Usually, relatives and close family friends are appointed and generally, they should be younger than the donor.
  3. LPAs are used in England only and are generally not recognised abroad.
  4. LPAs are only used during the donor’s lifetime.
  5. Once the LPAs have been signed by the donor, the Certificate Provider and the attorneys, they are sent to the Office of The Public Guardian (OPG) for registration. Currently, there is a registration fee of £92 per document. The OPG then takes approximately 3 months to issue the registered LPAs.
