Do I need a Property Survey when buying in Spain?

One of the most common questions we receive from foreign buyers is whether they should commission a property survey before purchasing a property in Spain.

The answer depends largely on the type of property being purchased. Whilst a survey may not always be necessary for every property, there are certain situations where obtaining professional advice from a qualified architect can be extremely valuable.


What is a Property Survey?

A property survey is an inspection carried out by a qualified architect to assess the physical condition of a property.

Depending on the type of survey commissioned, it may identify issues such as structural movement, damp, roof defects, retaining wall problems, swimming pool concerns, or other signs of deterioration that may not be immediately apparent to a buyer.

The purpose of a survey is not to decide whether you should buy the property, but to ensure that you understand its condition before making a legally binding commitment.


When Do We Strongly Recommend a Survey?

At My Lawyer in Spain, we particularly recommend considering a survey when purchasing:

  • Rural properties and traditional Spanish cortijos.
  • Older properties.
  • Properties with swimming pools.
  • Properties with retaining walls.
  • Properties that have been extended or significantly altered over the years.

Many rural and older properties have undergone multiple renovations throughout their lifetime, sometimes carried out decades apart. Whilst this does not necessarily mean there is a problem, it does mean that a professional inspection can provide valuable peace of mind.


Why Commission a Survey Before Signing the Private Purchase Contract?

Timing is important.

Ideally, any survey should be carried out before signing the Private Purchase Contract, when the buyer still has the opportunity to make a fully informed decision.

For this reason, whenever possible, we generally try to include a clause within the Reservation Contract making the purchase subject to a satisfactory survey report carried out by a qualified architect.

This allows buyers to obtain professional advice before becoming contractually committed to the transaction.


Why Do I Need a Survey If I Have Already Viewed the Property?

Many buyers visit a property several times before deciding to proceed and understandably feel confident about what they have seen.

However, the value of a survey lies in obtaining the opinion of a qualified professional.

An architect may identify issues that are not obvious to a non-specialist, but just as importantly, they can assess the significance of any defects that are visible and explain the potential implications and costs involved.

This allows buyers to make decisions based on professional advice rather than appearances alone.

How Much Does a Survey Cost?

As a general guide, a survey will often start from around €500 plus VAT, although the final cost will depend on factors such as the property’s size, location and complexity.

When compared to the potential cost of major repairs, many buyers consider this to be a worthwhile investment and an important part of the purchasing process.


Final Thoughts

A survey may not be necessary in every transaction. However, when purchasing an older property, a rural house, a traditional cortijo or a more complex property, we strongly believe that obtaining professional advice from a qualified architect is often money well spent.
