When was the Last Time you Reviewed your Will?
Do you live in Spain and have assets here and in other countries?
Have you moved house, country or got separated or divorced? Or even married? Have your life circumstances changed? Do you now have grandchildren? Have any of your heirs named in your will died?
Generally, we would recommend that you review your will every 3 to 5 years unless one of the above important life changing events occurs in which case, it maybe important to change your will entirely and sooner than the 3 to 5 year recommendation.
If you have assets in two countries it would be important to have a will in each country as the procedure for inheritance in each country is different. For example, in Spain there is an obligation to deal with the inheritance within 6 months and if the inheritance is not completed within this period, then you could be liable to interest on any tax due and charges.
Out-dated wills can leave to disputes between heirs, tax bills and challenges to implement the wishes of the deceased.
At My Lawyer in Spain we have a dedicated team of legal specialists who can help you make a Spanish will. We prepare the Spanish will in English & Spanish, it is then reviewed by you and once approved, we would arrange for you to sign your Spanish will before a Notary Public who will then notify the Civil Registry that a Spanish will has been signed by you. If you cannot make it to Spain, we can arrange for the will to be signed online with our English speaking notary.
